1. Introduction and Definitions
These Terms and Conditions govern the provision of web hosting and related services by webhostconfig.com ("we", "us", "our") to you ("you", "your", "the customer", "the client").
By ordering, purchasing, or using any of our services, you agree to be bound by these terms. If you do not agree with any part of these terms, you should not use our services.
In these terms:
- "Services" refers to web hosting, email hosting, domain registration assistance, and any related services we provide.
- "Account" means the customer account you create with us to manage your services.
- "Server" refers to the computer systems and infrastructure used to provide the services.
- "Website" or "Site" refers to any website or web application hosted using our services.
2. Agreement Formation
A binding agreement between you and us is formed when you place an order for services and we confirm acceptance of that order. Until we confirm your order, no contract exists between us.
We reserve the right to decline any order at our discretion without providing a reason. If we decline your order after payment has been taken, we will refund the payment in full.
You confirm that all information you provide to us is accurate, complete, and truthful. If any information you provide is found to be inaccurate, we may suspend or terminate your services.
3. Our Services
We will provide the services as described at the time of your order. We will make reasonable efforts to deliver services promptly and to a professional standard.
We may use third-party infrastructure providers and data centres to deliver our services. Our services are provided from UK-based data centres unless otherwise specified.
Any actions taken through your account are your responsibility. You must keep your login credentials secure and notify us immediately if you believe your account has been compromised.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. Where practical, we will provide reasonable notice of significant changes.
4. Service Availability
While we strive for continuous availability, we cannot guarantee uninterrupted access to our services. Factors outside our control, including internet connectivity issues, third-party system failures, and force majeure events, may affect availability.
We will make reasonable efforts to maintain our systems and keep them updated. Scheduled maintenance will typically be performed outside of peak hours where possible, and we will endeavour to notify you in advance of planned maintenance that may affect your services.
Important: In the event of service downtime or unavailability, any compensation or remedy is strictly limited to the value of the hosting fees you have paid for the affected period. We do not accept liability for any consequential losses, lost business, lost revenue, lost data, or any other damages arising from service interruptions.
5. Payment Terms
Prices for our services are as quoted at the time of order. All prices are in British Pounds (GBP).
Payment is due in advance for all services. Services will not be activated until payment has been received and cleared.
We accept payment by bank transfer, PayPal, and major credit or debit cards. You are responsible for any fees charged by your payment provider.
Invoices for service renewals will be issued in advance of the renewal date. If payment is not received by the due date, we may suspend your services. Continued non-payment may result in termination of your account and deletion of your data.
We reserve the right to change our prices at any time. Price changes will apply to new orders and renewals placed after the change takes effect. We will notify existing customers of price changes before their next renewal.
If payment is reversed, charged back, or otherwise disputed after services have been provided, we reserve the right to immediately suspend your services until the matter is resolved.
6. Cancellation
You may cancel your services at any time by contacting us in writing (email is acceptable). Cancellation requests should be submitted at least 7 days before your next renewal date to avoid being charged for the next period.
Upon cancellation, your services will remain active until the end of your current paid period unless you request earlier termination.
Domain name registration fees, SSL certificate fees, and other third-party costs are non-refundable once the relevant service has been activated or the domain registered.
We do not offer partial refunds for unused portions of a billing period.
7. Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these terms. You are responsible for all content stored on or transmitted through your hosting account.
You must not:
- Use our services to host, store, or transmit any unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable material.
- Host content that infringes any patent, trademark, copyright, or other intellectual property rights.
- Send unsolicited bulk email (spam) from our servers or use our services to promote websites that engage in spam.
- Attempt to gain unauthorised access to any systems, networks, or accounts.
- Upload or distribute viruses, malware, or other malicious code.
- Use excessive server resources in a way that negatively affects other customers.
- Host adult content, gambling services, or any content that is illegal in the United Kingdom.
- Engage in any activity that could damage our reputation or the reputation of our infrastructure providers.
We reserve the right to remove any content that we deem inappropriate without prior notice. Serious or repeated violations may result in immediate termination of your services without refund.
8. Your Responsibilities
You are responsible for maintaining the security of your account, including keeping passwords secure and not sharing access credentials with unauthorised persons.
You are responsible for maintaining your own backups of all data stored on our servers. While we may maintain backups for our own operational purposes, we do not guarantee the availability, completeness, or integrity of any backup data.
You must ensure that your website and any software you install is kept up to date and properly secured. We are not responsible for security breaches resulting from outdated or vulnerable software on your account.
You must ensure that any email sent from your account complies with applicable laws, including data protection legislation and anti-spam regulations.
9. Domain Names
Where we assist with domain name registration, you acknowledge that domain registration is subject to the terms and conditions of the relevant domain registry (such as Nominet for .uk domains, or ICANN for generic top-level domains).
We cannot guarantee that any particular domain name will be available or that registration will be successful. You should not assume a domain is registered until you receive confirmation.
You are responsible for ensuring that your chosen domain name does not infringe third-party rights. We accept no liability for disputes arising from your choice of domain name.
Domain registration and renewal fees are non-refundable once the domain has been registered or renewed. We will not release a domain to another registrar until all outstanding fees have been paid.
10. Data Protection
We will process your personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation and the Data Protection Act 2018.
Where you store personal data belonging to third parties on our servers, you are the data controller and are responsible for ensuring you have appropriate legal grounds for processing that data. We act as a data processor on your behalf.
We will implement appropriate technical and organisational measures to protect data stored on our systems. However, no system is completely secure, and you acknowledge that there are inherent risks in transmitting data over the internet.
You agree to comply with all applicable data protection laws in relation to any personal data you process using our services.
11. Limitation of Liability
Please read this section carefully as it limits our liability to you.
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to our services is limited to the amount you have paid us for the specific service giving rise to the claim in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business
- Loss of data or data corruption
- Loss of goodwill or reputation
- Loss of anticipated savings
- Any losses arising from business interruption
We do not guarantee that our services will be error-free, uninterrupted, or free from security vulnerabilities. We are not liable for any losses arising from circumstances beyond our reasonable control, including but not limited to internet outages, cyber attacks, natural disasters, or actions of third parties.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
You agree to indemnify us against any claims, losses, or damages arising from your use of our services, your breach of these terms, or your violation of any third-party rights.
12. Service Interruptions and Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control. This includes, but is not limited to: natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyber attacks, pandemics, and actions of third parties.
In the event of a prolonged force majeure situation lasting more than 90 days, either party may terminate the agreement without liability.
13. Termination
We may suspend or terminate your services immediately if:
- You breach any of these terms and conditions
- Payment is not received when due
- We reasonably believe your account is being used for unlawful purposes
- Your use of our services negatively affects other customers
- We are required to do so by law or by our infrastructure providers
Upon termination, you will lose access to your services and data. It is your responsibility to ensure you have copies of any data you wish to retain before termination.
Any fees paid for the period following termination for cause will not be refunded.
14. Changes to These Terms
We may update these terms from time to time. The current version will always be available on our website.
If we make significant changes that affect your rights, we will notify you by email before the changes take effect. Your continued use of our services after changes take effect constitutes acceptance of the updated terms.
If you do not agree with any changes, you may cancel your services before the changes take effect.
15. General Provisions
These terms constitute the entire agreement between you and us regarding our services. Any prior agreements, representations, or understandings are superseded by these terms.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these terms without our written consent. We may assign our rights and obligations to a third party, for example in the event of a business sale or restructure.
These terms do not create any rights enforceable by any person who is not a party to them.

Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
